Terms and Conditions

1. RENT AND PAYMENT

1.1 The monthly rent of ₹25,000/- shall be paid by the Tenant to the Landlord on or before the 5th day of each month.

1.2 Rent shall be paid via bank transfer/UPI/cheque to the Landlord's account:

1.3 A delay in payment beyond 10 days will attract a late fee of ₹100 per day.

2. SECURITY DEPOSIT

2.1 The Tenant has paid a security deposit of ₹75,000/- (equivalent to 3 months' rent) to the Landlord.

2.2 The security deposit shall be refunded without interest within 30 days of vacating the premises, after deducting:

  • Any outstanding rent or utility bills
  • Cost of repairs for damages beyond normal wear and tear
  • Any other dues as per this agreement

3. UTILITY BILLS AND MAINTENANCE

3.1 The Tenant shall pay all utility bills directly:

  • Electricity Bill - As per meter reading
  • Water Bill - As applicable
  • Piped Gas Bill - As per meter reading
  • Internet/DTH - As per Tenant's subscription

3.2 Society Maintenance Charges of ₹3,500/- per month shall be borne by the Landlord.

4. USE OF PREMISES

4.1 The premises shall be used exclusively for residential purposes by the Tenant and their immediate family members.

4.2 The Tenant shall not sublet, assign, or part with possession of the premises.

4.3 No structural alterations or modifications shall be made without written consent of the Landlord.

4.4 The Tenant shall maintain the premises in good and habitable condition.

5. PROHIBITED ACTIVITIES

The following activities are strictly prohibited:

  • Running any business or commercial activity
  • Keeping pets without prior written consent
  • Causing nuisance to neighbors
  • Illegal activities of any nature
  • Storing hazardous materials
  • Loud music/parties after 10:00 PM

6. REPAIRS AND MAINTENANCE

6.1 Landlord's Responsibility:

  • Major repairs (structural, plumbing, electrical wiring)
  • Replacement of fixtures due to normal wear
  • External repairs and waterproofing

6.2 Tenant's Responsibility:

  • Day-to-day maintenance and minor repairs
  • Repairs due to Tenant's negligence
  • Replacement of consumables (bulbs, taps, etc.)

7. LOCK-IN PERIOD AND TERMINATION

7.1 There shall be a lock-in period of 6 months from the commencement date.

7.2 After the lock-in period, either party may terminate this agreement by giving 2 months' written notice.

7.3 Termination during lock-in period:

  • Tenant must pay rent for remaining lock-in period or forfeit equivalent deposit
  • Landlord must refund deposit plus 2 months' rent as compensation

8. RENEWAL

8.1 Upon expiry, this agreement may be renewed by mutual consent.

8.2 Rent may be revised by a maximum of 10% upon renewal.

8.3 A new agreement shall be executed for the renewed term.

9. INSPECTION RIGHTS

9.1 The Landlord or their authorized representative may inspect the premises with 24 hours prior notice.

9.2 Inspection shall be during reasonable hours (9 AM to 7 PM).

10. VACATING THE PREMISES

Upon vacating, the Tenant shall:

  • Return all keys and access cards
  • Clear all outstanding bills and dues
  • Remove all personal belongings
  • Hand over the premises in the same condition (normal wear excepted)
  • Provide forwarding address for correspondence

Dispute Resolution

Any disputes arising from this agreement shall be resolved through:

  1. Mutual Discussion - First attempt at amicable resolution
  2. Mediation - Through a mutually agreed mediator
  3. Jurisdiction - Courts of New Delhi shall have exclusive jurisdiction
